TIMESHARE LAWTimeshare Attorney, New Smyrna Beach, Forida

JAMES M. KOSMAS, P.A., has been representing timeshare developers, associations, management companies and owners since 1981. Our extensive experience includes all aspects of timeshare plan creation, registration, sales and operations. Practice areas include the following:

Timeshare Resales

Many timeshares are purchased and sold on the secondary market, either through friends, relatives or the internet. The value of purchasing through a secondary market is buyers can receive the use and benefits of a timeshare at a reduced cost. However, when entering into any timeshare contract or agreement, it is crucial to have a timeshare attorney review your objectives and ensure the transaction achieves your goals. Even if you are already working with a lawyer, it is worth the second look from an experienced timeshare lawyer if it can protect you and your family. We act as co-counsel on matters involving timeshare law. Already signed a timeshare contract? We can examine your situation, discuss your options moving forward and protect your rights.

Timeshare Purchasers

It is important to understand your rights when purchasing a timeshare. You want to ensure you are asking the right questions, and your contract includes everything that has been promised. It is recommended that you keep all of the information the developer or seller gives you in addition to your timeshare contract. Florida has extensive advertising laws that protect buyers from false or misleading advertising in sales presentations and brochures.

Developer Transactions

JAMES M. KOSMAS, P.A. has advised timeshare developers in project acquisition and sales, structuring, creating, and documenting resort developments; preparing Florida and other state registration and disclosure requirements; marketing and sales; and structuring and documenting complex financing facilities, including acquisition, development, construction, consumer receivable and hypothecation loan transactions. We also represent clients in governmental investigations in areas of direct marketing and sales, including telemarketing and "do not call" compliance.

We have extensive experience in drafting Federal and State consumer disclosure documents, drafting all required documents for the registration of various timeshare plans located in or outside the State of Florida, including registration with the Florida Department of Business and Professional Regulation, Division of Florida Land Sales, Condominiums and Mobile Homes. We have also registered various Florida timeshare plans for sale outside of Florida.

Out of State Registrations and Sales

As timeshare laws vary by state, it is important that you review your state's legislation to be sure that the transaction is conducted correctly and lawfully. JAMES M. KOSMAS, P.A. recognizes it is vital that you understand your rights involving cancellation, resale, foreclosure defense, and more.
